AestheticData Terms of Service

These Terms of Service ("Terms") govern your use of AestheticData, a paid data API available at https://api.aestheticdata.io (the "Service"). The Service is operated by Hephaestus SASU (SIREN 930 576 111), 14 rue Bausset, 75015 Paris, France ("we", "us"). By sending a request to the Service, or by paying for one, you agree to these Terms. If you are an AI agent acting for a person or organisation, that person or organisation is bound by these Terms.

1. How the Service works

AestheticData is pay-per-request. There are no accounts and no API keys. Each call is paid individually using the x402 protocol (HTTP 402 Payment Required), in USDC on Base mainnet, settled through the Coinbase CDP facilitator.

When you call a paid endpoint without payment, the Service replies with a 402 challenge stating the price and payment details. Once your client submits a valid payment, the Service returns the requested data.

2. Endpoints and prices

Prices can change. The current price is always shown in the 402 challenge before you pay, and the price in that challenge is the price you pay for that request.

3. Payments are final

Payments are made onchain and are final. We do not offer refunds, with one exception: if you paid for a request and it failed because of a problem on our side (a server-side error), contact us at alphaglobalus@proton.me with the transaction hash and, if available, the request id, and we will look into it.

You are responsible for your wallet, your keys, any network fees, and making sure your client pays the correct amount to the correct address.

4. The data: as-is, for information only

All data is provided "as is" and "as available", for information only.

• It is not medical, legal or regulatory advice.
• We make no guarantee that it is accurate, complete or up to date.
• EU device data is derived from public EUDAMED sources. Check the data_as_of date, and verify anything important against the official EUDAMED source before relying on it.

You are responsible for how you use the data and for any decisions you make based on it.

5. Acceptable use

You agree not to:

• abuse the Service or scrape it beyond the access you have paid for;
• attempt to bypass, avoid or tamper with payment, including replaying, forging or reusing payments;
• use the Service for any unlawful purpose, or in a way that interferes with the Service or other users.

We may rate-limit, throttle or block any client, wallet or traffic that we reasonably believe is abusive or breaks these Terms.

6. Availability and changes

We may change, suspend or discontinue the Service, its endpoints or its prices at any time. Because there are no subscriptions or prepaid balances, each paid request stands on its own.

We may update these Terms. The effective date at the top shows the latest version. Continuing to use the Service after a change means you accept the updated Terms.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss arising from reliance on the data. Our total liability for any claim relating to the Service is limited to the amount you paid for the request(s) giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Governing law

These Terms are governed by the laws of France. Disputes will be handled by the competent courts of Paris, France, unless mandatory law says otherwise.
